Case Overview

Our client was shown, by a close acquaintance, a bank balance certificate doctored to look as if the account held billions of won. The acquaintance promised, "Lend me the money and I will pay you back soon and lend you even more." Trusting this, the client took out a card loan and lent about KRW 40 million. The other party repaid nothing after the promised date and stopped answering calls. In the meantime, the client's finances became so strained that they had to put their own home up for sale.

Our Strategy

Attorney Dongwoo Shin organized the loan agreement, the written pledge, KakaoTalk messages, bank transfer records and card statements one by one, proving the loan and the defendant's promises with objective evidence. He focused in particular on the pledge, in which the defendant promised to "pay KRW 300 million, including the borrowed money, by [date] 2026." On that basis he increased the claim to KRW 300 million during the lawsuit and argued both repayment of the loan and liability in tort, leaving no gaps in the claim. When the defendant filed no answer and did not appear in court, the court accepted all of the client's claims and ordered payment of KRW 300 million plus late-payment damages — a full win.
