Win on Joint Liability in Unlisted Cryptocurrency Mission Scam, Rejecting the 'Remittance Part-Time Job' Defense
1. Case Overview
Our client was signed up, through a promotional call, on an app impersonating a cryptocurrency exchange (ZENDRIX), and suffered losses by remitting a total of KRW 39.8 million to an account in the defendant's name under the pretexts of performing listing-support missions and paying penalties for failure.
2. DAEON's Strategy
When one of the defendants claimed to have had no intent, asserting that he was 'a victim deceived into a simple remittance-agent part-time job,' DAEON's attorneys zeroed in on the fact that he had taken a high 5% commission merely for making transfers, sharply establishing negligent aiding-and-abetting liability for the criminal use of the account. We thereby obtained not only full recognition of KRW 38.9 million against the defendant served by public notice, but also a joint-liability judgment holding the remittance-courier defendant, who had denied responsibility, liable for joint tort.
