Full Win on Primary Joint Tort Claim Against Borrowed-Name Bank Account Holders in Electronic Financial Fraud
1. Case Overview
Our client, deceived by the fraudulent conduct of a new type of electronic financial fraud ring, remitted more than KRW 15.85 million in total to bank accounts in the defendants' names, and then ran into severe difficulty recovering the losses when contact with the ring was lost.
2. DAEON's Strategy
DAEON's attorneys set the goal of swiftly securing an enforceable title by leveraging the procedural features of small-claims litigation, and proved with intuitive, clear-cut evidence that the defendants' lending of their accounts met the elements of a tort that aided the fraud. The court fully adopted DAEON's reasoning, recognizing the primary joint tort liability as pleaded without needing to rule on the alternative claim, and rendered a complete winning judgment ordering each of the defendants to pay the full KRW 15,859,625 in losses plus default interest at 12% per annum.
