Divorce Mediation with Complex Property Relations
1. Case Overview
Our client (the petitioner) applied to the Ulsan Family Court for divorce mediation in order to bring the marriage to an amicable end. Beyond simply confirming the intention to divorce, the matter involved several sharply contested issues: securing parental authority and Custody of a minor child, setting future child support, and a complex Division of Property including both spouses' pensions. In particular, the two sides were far apart on the scale of the property division and child support, raising serious concern about the psychological and financial toll on our client if the dispute escalated into prolonged litigation.
2. DAEON's Strategy
Managing Attorney Shin Dong-woo of DAEON Law Firm pursued a swift and decisive mediation strategy to cut off unnecessary and draining emotional battles early and deliver the most substantively beneficial outcome for our client. Through careful negotiation, he secured our client's full right to claim a divided share of the other party's various pensions (F, G and H pensions, among others), while reaching a favorable settlement that cleanly resolved the other complex property relations according to the name in which each asset was held. He further had our client designated as sole custodial parent and guardian, and fully secured child support terms that increase with the child's age up to KRW 2 million per month, successfully supporting our client's new start.
