Adultery Suit: Affair with a Coworker
1. Case Overview
In this matter, the plaintiff's spouse maintained a private intimate relationship with a third party under the pretext of a business relationship, going so far as to provide financial support, and the marriage broke down as a result. The third party flatly denied the infidelity, insisting it was merely a 'business consulting relationship,' and tried to evade legal liability by claiming that the substantial financial support was likewise business-related. Our client (the plaintiff), suffering emotional distress from the spouse's affair, came to DAEON Law Firm to claim rightful Consolation Money from the third party.
2. DAEON's Strategy
To break the 'business relationship' framing asserted by the adulterous third party, Attorney Shin Dong-woo took the direct approach of meticulously analyzing the specific financial support and communication records exchanged between the two. In particular, he relentlessly pursued the contradiction between the compensation stated in the labor-management consulting contract the third party cited and the large sums that actually changed hands, clearly proving that the support stemmed from a private romantic relationship, not business. He also presented thousands of call records, including late-night hours, and evidence of personal movements to forcefully establish that the infidelity was legally clear. As a result, the court rejected all of the third party's excuses, granted the plaintiff's claim in full, and DAEON secured a complete win with Consolation Money of KRW 30,000,100.
3. Result - KRW 30M Consolation Money
