Representing the Complainant: Indecent Assault and Filming by a Company CEO
1. Case Overview
The complainant belatedly learned that, while intoxicated and unable to resist, she had been illegally filmed with her body exposed by the CEO of her former company, and that the footage had been transmitted to and stored on a work phone. The accused had abused his dominant position as CEO to pressure the victim into frequent company dinners and drinking sessions, repeatedly committing the offenses while she slept, and even had the audacity to transmit the material to a work device. In extreme psychological distress, the victim entrusted the case to DAEON Law Firm, petitioning for the accused's severe punishment.
2. DAEON's Strategy
In this case, Attorney Shin Dong-woo of DAEON Law Firm devoted every effort to meticulous evidence gathering and sharp application of the law, grounded in a sincere refusal to turn away from the victim's suffering. Although the case initially struggled for lack of favorable evidence, he clearly established the accused's filming and transmission of the illegal footage on the basis of KakaoTalk conversations and photographic evidence obtained from a colleague, and in particular argued tenaciously, citing relevant precedent, that transmitting and storing the footage on a work phone—beyond the mere act of filming—constituted 'new possession under social norms.' Through this strategic approach, he secured a formal indictment from the Prosecution on all charges of Quasi-indecent Assault and violation of the Act on the Punishment of Sexual Crimes (Illegal Filming and possession of illegally filmed material).
