Representing the Complainant: Habitual Illegal Filming and Indecent Assault by Abuse of Authority in the Workplace
1. Case Overview
The victim suffered repeated sexual violations by a superior at the workplace where she had worked for many years. The defendant exploited his dominant position in the workplace to summon the victim to enclosed spaces such as the materials warehouse and commit indecent assault by abuse of authority, and installed hidden cameras at the company and at homes to secretly film the victims undressing on hundreds of occasions. The offenses were carried out deliberately over a long period, and the body parts filmed and the degree of exposure in the footage were also grave.
2. DAEON's Strategy
Our client had endured sexual humiliation and fear in prolonged silence, carrying complex harm that a criminal complaint alone could not resolve. I focused on proving the gravity of the case by combining the specificity and consistency of the victim's statements, a psychiatric diagnosis, and the results of the forensic examination of the scene. In particular, I emphasized that the illegally filmed materials numbered in the hundreds and that the defendant had used his position to block the victim's resistance, persuading the court of the need for a severe sentence. During the trial the defendant cited his remorse and a partial settlement, but I highlighted that the victim's clear wish for punishment and her unhealed psychological harm carried greater weight, securing a prison sentence.
3. Result - 1 Yr 2 Mo Prison / KRW 60M Settlement
