The Truth Behind 'I Was Hit by a Car'… Pedestrian Accident Ends in Acquittal
1. Case Overview
The defendant, who was driving up to an unsignalized crosswalk, was suddenly hit with a criminal complaint based on a pedestrian's claim that 'I was hit by the car.' The victim complained of pain in the leg and alleged a contact accident, and the matter quickly escalated into a pedestrian traffic accident case. What was a simple situation on the road became, for the defendant, a crisis that could end in criminal punishment.
2. DAEON's Strategy
I secured the CCTV and dashcam footage recorded at the time of the accident and proved that the vehicle had slowed down before the crosswalk and stopped at a certain distance from the victim. Through witness testimony, I also established that the reason the victim suddenly stopped was closer to 'being startled' than 'contact with the vehicle.' The court gave weight to both the footage and the testimony, held that subjective pain alone could not establish that contact had occurred, and acquitted the defendant. So that innocent drivers are not punished on the basis of false claims, I fight against the risk of wrongful accusations and defend the truth to the end.
