The defendant faced a criminal complaint for allegedly making an inappropriate, joking remark about the victim during the light, bawdy banter that flowed with the mood at an evening drinking gathering with club acquaintances. The victim and the defendant had remained on friendly terms up to that point, and the others present who heard the remark in question also took it as a joke. The Prosecution nonetheless indicted the defendant for Defamation, judging that the remark could lower the victim's social standing.

In this case, I made the overall atmosphere of the gathering, the nature of the conversation, the relationship with the victim, and the statements of those present the core of the defense. In particular, I emphasized that there was no indication whatsoever that the remark had been spread outside, and that even those present had perceived it as 'humor.' The court found that neither the 'possibility of dissemination' nor the 'intent' required for Defamation could be established, and ultimately acquitted the defendant. As this case shows, an offhand remark can lead to a wrongful complaint; the risk of wrongful accusations always begins in the cracks of relationships.
