Imitative Rape Complaint Between Friends… A Case That Ended in Acquittal
1. Case Overview
This case began when the defendant was accused of Imitative Rape by a woman who had been a longtime friend. The issue centered on the victim's statements: the content of her statements to investigators and in court changed repeatedly, with new details added belatedly, raising serious doubts about their consistency and credibility. Moreover, taking together the circumstances at the scene, the victim's conduct at the time, the time that elapsed before the complaint, and the reactions of those around them, it was untenable to regard the defendant's conduct as a sexual act based on force.
2. DAEON's Strategy
Rather than attacking the victim's statements without basis, I built the defense by rebutting, one by one, the specific points that conflicted with the defendant's account. In particular, where the victim could not remember or repeatedly gave contradictory statements, I presented the sequence of facts and the circumstances at the time together with objective materials to offer a persuasive counterargument. The court acquitted the defendant, holding that 'the victim's statements alone are insufficient to prove the charges.' Sex crime cases are by nature highly sensitive and call for great care, but maintaining legal balance so that an innocent defendant does not suffer from a wrongful accusation must never be neglected either. The risk of wrongful accusation is a problem that can befall anyone, and I am an attorney who never backs down from the fight to right that injustice.
