Took the Wrong Sneakers at the Gym and Accused of 'Theft'… Acquitted in the End
1. Case Overview
In this case, the defendant was indicted on a 'Theft' charge after taking another person's sneakers from a gym, mistaking them for his own. At the time, the defendant believed a pair of black Adidas sneakers were his, put them in his shoe bag and went home, and the victim promptly reported them stolen. However, the shoes were nearly identical to the defendant's own in design, stripes and color, and the defendant, without so much as reporting it, left them in his bag until the Police contacted him, whereupon he immediately handed them over voluntarily.
2. DAEON's Strategy
I emphasized the absence of any intent to steal, focusing on the facts that the defendant had never even worn the shoes, that the likelihood of a mistake was high, and that he voluntarily handed them over immediately after being contacted by the Police. I further presented the defendant's usual habits, the way he kept his shoes, and the environment inside the gym to demonstrate that this was a genuine mistake. The court found that 'it is difficult to find any intent to steal' and acquitted the defendant. As this shows, inadvertent mistakes often escalate into criminal cases. The risk of wrongful accusations can arise anytime, anywhere.
