'Rape' Claim After a Lovers' Quarrel… Acquitted of Defamation
1. Case Overview
This case was a criminal complaint between two people who had been in a romantic relationship, and the issue was whether the defendant's telling those around her that she 'was forced into sex' constituted Defamation by alleging false facts. The complainant argued that the statement was entirely untrue and that he could have been mistaken for a rapist. The defendant, on the other hand, maintained that she had perceived the sexual encounter at the time as forced, and that the statement came out while she was confiding her distress to people around her after an emotional conflict.
2. DAEON's Strategy
I presented a detailed analysis showing that the defendant's statement could not be objectively determined to be entirely false, and covering the emotional context between the couple, the defendant's perception at the time, and the circumstances in which statements changed during the investigation. I also emphasized that the statement was in effect made in the form of a private consultation, with no intent to actually damage the complainant's reputation. The court ultimately acquitted the defendant, holding that 'it cannot be concluded that the defendant's statement was false, and the intent to defame is difficult to find.'
Statements relating to sex crimes are an extremely sensitive matter, but the effort to speak the truth and the work of exposing false accusations must go hand in hand. The risk of wrongful accusations can begin with a misunderstanding within close emotional ties.
