The defendant was riding the subway as usual when, on the platform, a woman accused him of illegal filming and a confrontation broke out. The other party suddenly pressed the defendant and shouted at him, and the defendant tried to grab the victim's arm to clear up the unfair misunderstanding. However, CCTV captured the victim stepping backward, losing her balance and falling, and the defendant was immediately accused of Assault and sent to criminal trial.

From the outset, I focused on securing the CCTV footage that clearly showed the circumstances at the time. The footage contained no scene of the defendant deliberately pushing or forcefully pulling the victim; rather, it showed the defendant, flustered, trying to explain the situation. During the trial, I concentrated on the fact that the defendant's contact was an attempt to clear up the situation and that the victim's fall was accidental. The court ruled that intent had not been clearly proven and acquitted the defendant. As this case shows, even a small everyday collision can escalate into the risk of a wrongful charge.
