This stalking case involved a defendant who kept approaching and harassing the victim even after she had refused contact and made clear she wanted to end the relationship. The defendant waited for and followed the victim outside her workplace, and even after she left her job he appeared in front of her former workplace holding banners bearing insulting phrases such as 'gold digger' and 'whore,' causing humiliation and anxiety and refusing to stop his stalking. Even after the victim blocked his number, he left multiple missed calls in continued attempts at indirect contact. This repeated, persistent conduct caused constant threat and fear in the victim's daily life, and her psychological harm was substantial. The court found that the defendant's conduct violated the Stalking Punishment Act and constituted insult under the Criminal Act, and, giving serious weight to his unrepentant attitude, persistent approaches, and use of strongly insulting language, sentenced him to eight months in prison and ordered him to complete 40 hours of a stalking treatment program.

Despite prolonged harassment, our client found the courage to come forward, and from the very beginning I prepared a careful legal response to ensure her voice would never be distorted in court. In particular, I focused on showing that the stalking was not merely repeated contact but a structural form of violence that violated the victim's life and dignity. I organized every circumstance in concrete detail for the court, including the wording of the banners, the defendant's manner of approach, and the records of missed calls after the victim blocked his number, and structured the opinion brief so that his unrepentant persistence, and the fact that he kept stalking her even after she left her job, would be fully reflected in sentencing. This was not a minor offense but a serious human rights violation combining persistence and premeditation. To ensure the victim's psychological suffering received real protection, I advised her not only on criminal punishment but also on legal measures to prevent secondary harm going forward. Stalking cases may appear trivial, but without an effective response they can drag on and lead to far greater harm. In particular, when a victim handles a settlement or the criminal process alone, there is a high risk of being dragged into absurd terms or of a result that favors the perpetrator. I am confident in a strategic response that protects the victim's rights and, where necessary, secures firm punishment.
