Victim Representation — Workplace Sexual Molestation by a Superior Abusing His Position; 'One Year Six Months in Prison'
1. Case Overview
This sex crime case involved a workplace superior who used his position to repeatedly touch the bodies of female subordinates and make sexual remarks. Abusing his position as branch manager, the defendant engaged in continual molestation and demeaning language, and the victims were found to have suffered psychological harm over an extended period. The victims' statements were consistent, and evidence supporting the circumstances, along with third-party statements, was also secured. Some victims were receiving psychiatric treatment, and one victim even suffered a miscarriage as a result of the incident.
2. DAEON's Strategy
For the victims, this was not a matter that could be resolved by a simple apology or monetary compensation. Together with the victims, I organized memories of harm accumulated over several years and prepared meticulously so that each of their statements would hold firm throughout the criminal complaint process. Even as the defendant denied every charge, I built the evidence by combining the pattern of his repeated conduct, the consistency among the victims' statements, and objective materials. In court, I logically rebutted the defendant's assertions and, through the opinion brief, made sure the essence of the case was conveyed clearly from the victims' perspective. The court imposed a prison sentence on the grounds of the multiple victims, the repeated offenses, the defendant's lack of remorse, and the real harm suffered by the victims, and my strategy played a central role in that outcome. This case confirmed once again that settlement and response in sex crime cases require strategic design, not emotional reaction. When a victim, swayed by emotion, negotiates a settlement alone, it frequently ends with an absurd sum and no proper apology, or with a result that favors the perpetrator. I am confident in taking responsibility for both pillars, settlement negotiation and criminal punishment, to protect victims' rights in substance. I will stand with victims to the end so that their courage is not in vain.
