This was a textbook real estate fraud case in which the defendant, without having returned his tenants' lease deposits, drew up false 'tenant move-out certificates' and used them to obtain loans totaling approximately KRW 1.6 billion from a financial company. Despite a prior fraud conviction, the defendant exploited gaps in the mortgage screening system and deceived the financial institution by making it appear on paper that the tenants had moved out. The victim financial company only belatedly learned that the lease agreements were still in effect; although part of the amount was recovered when the defendant's property went to auction, substantial losses remained.

This was a textbook economic crime in which the defendant's document fabrication and financial deception were intricately combined. Representing the victim from the earliest stage of the investigation, I focused on building the evidence systematically: documenting the unreturned lease deposits, comparing the original lease and move-out documents, and analyzing the financial records of the loan disbursement process. To prove that the defendant had engaged in deliberate deception rather than a mere mistake, I compiled his overall pattern of conduct, including his prior record of similar offenses, and reverse-engineered the financial institution's internal procedures to argue persuasively that the false certificates had no legal effect. From the victim's perspective, I also went beyond criminal punishment alone, presenting to the court the civil considerations relevant to the judgment so that the victim could later obtain real recovery of its losses through civil litigation. In economic crimes, the mere assertion that 'I was defrauded' is not enough to secure strong punishment. It takes a strategic approach that combines precise documentary and financial evidence, accurate application of the law, and a realistic path to recovering the victim's losses. In cases demanding this kind of complex judgment, I am highly confident in delivering results.
