Victim Representation — Retaliatory Assault and Extortion of Goods
1. Case Overview
In this case, the defendant subjected the victim to ongoing harassment, including repeated verbal abuse and assault and unlawful entry into the victim's home, and ultimately committed a retaliatory assault because the victim had reported him to the police. Nor did it stop there: the defendant also threatened a part-time worker on duty at a convenience store and repeatedly demanded goods, and this conduct was joined to the trial as a coercion charge.
2. DAEON's Strategy
This case involved a tangle of charges, including assault, trespass, retaliatory crime, and coercion, and with the defendant denying everything, there was a high likelihood of the proceedings dragging on. While minimizing the victim's psychological burden, I quickly organized the key evidence needed to prove guilt, and in particular emphasized the deliberate and repeated nature of the retaliatory conduct to draw a stern judgment from the court. I also argued forcefully that the defendant, despite having been punished several times before for assault and other offenses, had repeated his crimes without a trace of remorse, and that this should weigh heavily in sentencing. On the matter of settlement, the victim had at an early stage been contacting the perpetrator's side alone and trying to negotiate an amount, but I intervened promptly to prevent a negotiation unfavorable to the victim. In the end, we secured both a reasonable settlement and a prison sentence.
