Victim Representation — Man Who Repeatedly Delivered Obscene Letters to a Woman, Sentenced to Prison for 'Obscene Acts via Telecommunications'
1. Case Overview
This case began when a woman living an ordinary daily life started receiving repeated obscene messages. Without any relationship to the victim whatsoever, the defendant persistently delivered letters containing deliberate and distorted sexual content to her residence. The language was explicit and the repetition unmistakable, leaving the victim with no choice but to endure severe shame and psychological distress. Judging that she could no longer bear it alone, the victim sought legal assistance; the matter was treated as Obscene Acts via Telecommunications under the Act on Special Cases Concerning the Punishment of Sexual Crimes, and criminal proceedings were initiated.
2. DAEON's Strategy
The victim endured her suffering alone for a long time before finally seeking legal help to protect herself. Respecting that courage, I did not stop at simply filing a complaint; I launched a strategic response to ensure that real criminal punishment would follow. From the earliest stage, I presented objective evidence of the defendant's intent and the repeated nature of his conduct, and carefully documented the severity of the shame-inducing language and the psychological shock suffered by the victim in the opinion brief. On that basis, the court took a grave view of the defendant's offenses and reached the firm conclusion of a prison sentence. For the victim, this case means far more than a verdict. Alongside criminal punishment, my highest priority is that the victim's rights are protected throughout the proceedings and that she gains an opportunity for recovery through due legal process. In cases like this in particular, a victim who negotiates a settlement alone with the other side may be placed in a very unfavorable position, and the settlement itself may even be exploited. In practice, settlements reached without an attorney can differ by tens of millions of won. The law is a tool for victims. I do my utmost to ensure that role is realized in practice.
