Victim Representation — Nighttime Trespass and Attempted Rape Case Concluded with a 'Prison Sentence'
1. Case Overview
This case involved a late-night residential trespass and attempted rape that left the victim with severe terror and psychological trauma. The defendant climbed a drainpipe at night to break into a residential building; in one home he stole a gold necklace, and in another he threatened the victim and attempted to rape her. The victim experienced extreme fear during the attack and continued to suffer insomnia and anxiety afterward. Because the scene of the crime was the space of her daily life, the psychological impact was all the greater.
2. DAEON's Strategy
Immediately after the incident, the victim's sense of everyday safety had collapsed and she was suffering intense anxiety; because the offense involved a nighttime intrusion into her home, she felt the very space where it occurred was no longer safe, and she came to us for help. In this case I built a strategy that pursued criminal punishment and genuine recovery measures in parallel. From the earliest stage, I organized the evidence to concretely establish the defendant's method of entry, the premeditation of the offense, and the circumstances of the attempted rape, and submitted an opinion brief emphasizing the victim's terror and psychological harm. Although the defendant's remorse and family circumstances were given some weight, I ensured the court clearly recognized the gravity of the victim's suffering and the danger he posed to society. Beyond punishment alone, I also pursued civil remedies in parallel so that the victim could continue rebuilding a stable daily life after the case. In cases like this especially, when a victim, swayed by emotion, tries to settle directly with the perpetrator, the result is very often a loss. Differences of tens of millions of won in settlement amounts are not uncommon, and there are cases where the process is exploited outright. Protecting victims must not end with a criminal verdict. I always focus on using legal advocacy to build a real foundation from which the victim can stand up again, and in this case too I upheld a victim-centered approach to the very end.
