Scuffle with a Police Officer — Obstruction of Business, Obstruction of Justice, etc.
1. Case Overview
During an argument over smoking inside a restaurant, our client went so far as to use physical force against the police officer who responded to the scene, and was booked for obstruction of justice and assault. Crimes against public authority are treated with great severity by investigators and courts these days, and our client was in a precarious position where a prison sentence could easily have been unavoidable. Worse, his relationship with the injured officer had deteriorated to the point where he had no realistic way of reaching a settlement on his own.
2. DAEON's Strategy
Immediately after the incident, we closely examined how our client's impulsive offense came about and, above all, devoted every effort to reaching an amicable settlement with the injured police officer. Our attorney personally acted as a go-between, conveying our client's sincere apology, and succeeded in securing a settlement and the victim's statement that he did not wish to see our client punished. Alongside this, we thoroughly prepared and submitted multidimensional sentencing materials to the court, showing that our client had faithfully maintained his social ties, deeply regretted the offense, and was committed to never reoffending. In the end we persuaded the court, averting a prison term and obtaining the best possible outcome: a suspended sentence.
