Traffic Accident Act (Injury), Road Traffic Act (Drunk Driving)
1. Case Overview
Our client got behind the wheel with a blood alcohol concentration above 0.03% and caused a serious traffic accident by colliding with a city bus carrying numerous passengers. Because the collision involved a large vehicle such as a bus, the potential for casualties was very high, and the case was viewed as far more serious than ordinary drunk driving since it endangered many potential victims. Our client faced an extremely unfavorable situation, with heavy criminal punishment including a prison term expected.
2. DAEON's Strategy
Attorney Shin Dong-woo focused on the process rather than merely the outcome, reframing the defense so that the court would see our client not simply as 'a defendant who caused an accident' but as 'a member of society with no risk of reoffending and a high likelihood of rehabilitation.' We closely examined our client's age, upbringing, and the circumstances leading to the offense to identify mitigating factors, and systematically compiled and submitted evidence of his proactive efforts to make amends after the accident together with a heartfelt letter of remorse. Rather than merely listing sentencing materials, we set out our client's character and a concrete plan to prevent any reoffending in a legally coherent, well-reasoned submission that proved deeply persuasive to the court, ultimately producing the best possible result for our client.
