This real estate dispute arose when part of the property that the clan association (the plaintiff) had placed under title trust with several individuals passed by inheritance, and the defendant who inherited it disposed of it at his discretion. The plaintiff strongly objected to the defendant's sale of the property and filed suit, but from the defendant's standpoint this was an attempt to impose unjust liability over a matter already concluded. Despite having exercised a legitimate right to dispose of inherited property, the defendant found himself embroiled in a lawsuit demanding the return of a large sum, and felt his property rights and reputation were under serious threat.

Before contesting the substantive merits, Attorney Shin Dong-woo employed a sophisticated strategy focused on the 'procedural legitimacy' of the lawsuit the plaintiff had filed. After a thorough review of the record, we identified a fatal weakness: the plaintiff clan association had either omitted the mandatory 'resolution of the general clan assembly' required before filing suit, or the litigation had been brought by someone without authority to represent the association. On this basis, we forcefully argued that 'the plaintiff's filing itself is plainly defective for failing to go through a lawful internal resolution process,' steering the court toward dismissal. Rather than merely defending the legitimacy of the defendant's disposal of the property, we protected our client through an incisive strategy that neutralized the opposing party's standing to sue at its root.
