Building Trespass: Accused Over Entering a Study Café
1. Case Overview
Our client (the defendant) was indicted for Building Trespass after briefly entering a study café through the back door to use the printer. Our client had simply entered under the mistaken belief that printer use was freely permitted, with no intent whatsoever to unlawfully intrude on another's premises. However, the victim, who took offense at our client's demeanor during the investigation, petitioned for severe punishment, leading to an indictment; for a client preparing for examinations, a criminal record could have been a fatal disqualification for a future career, making it an extremely desperate situation.
2. DAEON's Strategy
From the moment the case was taken on, we mounted a tenacious and strategic defense to clear our client's name. First, we combed through the café's Instagram and KakaoTalk channels and other sources to uncover objective circumstances that gave the defendant reason to believe printer use was open to all at any time, and forcefully argued on legal grounds that there was no 'intent to trespass.' We further persuaded the court by submitting detailed materials showing that, even if the charge were upheld, our client was a model citizen with no criminal record whatsoever and no risk of reoffending. This persistent advocacy led the court to defer sentencing, giving our client the precious opportunity to move toward their dreams again without a criminal record.
3. Result - Deferred Sentence
