'I Didn't Know He Was Married'… Adultery Consolation Money Claim Without Evidence, Won With 'Full Dismissal'
1. Case Overview
The plaintiff filed an adultery Consolation Money suit alleging that our client (the defendant) had committed infidelity with the plaintiff's spouse. However, our client had been completely unaware at the time of the relationship that the other party was married—a victim of infringement of sexual self-determination—and there was no objective evidence whatsoever of the infidelity the plaintiff alleged, an unjust situation.
