Win on Joint and Several Liability of Borrowed-Name Bank Account Holders for Joint Tort in SNS Side-Job Team Mission Scam
1. Case Overview
Our client, approached by ring members offering an Instagram side job and a part-time job watching videos, took part in team missions on a fake platform and, subjected to continuous gaslighting about needing to clear order errors and unfreeze the account, was defrauded of more than KRW 45 million through accounts in the defendants' names.

DAEON's attorneys actively applied the doctrine of aiding and abetting a joint tort under Article 760 of the Civil Act against multiple borrowed-name bank account holders, asserting joint and several liability as the primary claim and restitution of unjust enrichment as the alternative claim in a multi-layered approach. Even amid the complex multi-party flow of funds, we clearly established that the provision of the accounts was an essential element that facilitated the organized fraud, obtaining a final judgment ordering the two key defendants to pay jointly and severally the full amount of over KRW 48.05 million.
