If you were in an accident with a pedestrian,
first pin down the location and the signal status

Accidents injuring pedestrians are among those that investigative agencies and courts treat most strictly. But the outcome changes greatly depending on whether the accident spot was on the crosswalk, what the pedestrian signal showed, and whether there was really any contact.

Key Points

  • If you neglect the duty to protect pedestrians at a crosswalk (Article 27(1) of the Road Traffic Act) and someone is injured, you are punished regardless of insurance (Article 3(2)6 of the Act on Special Cases Concerning the Settlement of Traffic Accidents (the “Traffic Accident Settlement Act”, 교통사고처리법)).
  • The penalty is up to 5 years of imprisonment without labor or a fine of up to KRW 20 million, and in a fatal accident the likelihood of a prison sentence increases.
  • If the accident happened outside the crosswalk, the pedestrian signal was red, or the person was not in the middle of crossing, it may not fall under the 12 serious-fault cases.
  • Some cases dispute whether there was a collision at all. DAEON Law Firm has obtained an acquittal against a pedestrian's claim that they were "hit by the car."

What the pedestrian protection duty requires

Article 27(1) of the Road Traffic Act requires that when a pedestrian is crossing or appears to be about to cross a crosswalk, the driver must stop temporarily before the crosswalk (at the stop line, if there is one) so as not to obstruct or threaten the pedestrian. The same applies when turning right. An accident caused by violating this duty is treated as a serious-fault accident under Article 3(2)6 of the Traffic Accident Settlement Act.

First, check whether it is really a crosswalk accident

  • Where the accident happened · We check whether it was inside the crosswalk or several meters away. Case law in principle does not include accidents outside the crosswalk in this category, even if near it.
  • The pedestrian signal · If the accident involved someone crossing against a red pedestrian signal, it may not be a breach of the protection duty (though other driver faults, such as running a signal, are examined separately).
  • The pedestrian's status · An accident after the person had finished crossing and stepped onto the sidewalk, or one involving someone riding a bicycle across the crosswalk, may be assessed differently.
  • Whether there was actual contact · We check whether the car was stopped and the pedestrian fell out of fright. Using dashcam and CCTV footage, we reconstruct when the car stopped and its distance from the pedestrian.

Be careful with accidents while turning right

Collisions with pedestrians on a crosswalk while turning right at an intersection are common. At the crosswalk right after a right turn, you must stop if a pedestrian is crossing or about to cross. Such accidents are almost always assessed as a breach of the protection duty, so prepare settlement and sentencing materials promptly.

Why insurance is not a safe harbor · A driver with comprehensive insurance is in principle not indicted for causing injury by occupational negligence (Article 4 of the Traffic Accident Settlement Act), but breach of the crosswalk protection duty is listed among the exceptions, together with running a signal, driving without a license, drunk driving (officially “driving while intoxicated”) and others. The same applies where there was also a hit-and-run or refusal of a breath test, or where the victim suffered a life-threatening serious injury.

Preparing to reduce the penalty

  1. Secure footageCollect the dashcam footage, nearby CCTV, and signal cycle data to pin down the accident location and signal status.
  2. Repair the harmPursue a criminal settlement covering medical costs and compensation for distress, and if that is difficult, consider a deposit with the court.
  3. Organize sentencing materialsDocument an accident-free driving record, a job that requires driving, and conscientious conduct after the accident such as giving aid and visiting the hospital.

Frequently Asked Questions

I hit someone jaywalking right next to a crosswalk.
An accident outside the crosswalk is in principle not a breach of the crosswalk pedestrian protection duty. In that case, if you are insured, the case may end with a "no right of prosecution" decision (the case cannot be charged), but the degree of injury and whether there were other violations must also be examined.
My car was stopped, but a pedestrian filed a complaint saying they fell.
If there was no actual contact, a traffic accident itself may not be found. In a case handled by DAEON Law Firm, we proved through dashcam and CCTV footage that the vehicle stopped at a distance, and obtained an acquittal.
How is the settlement amount for a pedestrian accident decided?
It is decided by considering the degree of injury, the treatment period, any lasting disability, the victim's own fault, and the scope covered by insurance. Also check first whether a rider on your driver's insurance covers criminal settlement money.
