Forced Heirship (Legal Reserve) Claims
A legal reserve claim is a lawsuit to recover the legal reserve (forced share): the minimum portion of the estate that Korean inheritance law guarantees to each heir,
regardless of the decedent's wishes. It can be pursued at the same time as a division-of-inherited-property action. Unlike a division action, however, a legal reserve claim
is subject to strict filing deadlines. It is therefore important to understand the legal reserve system precisely, so that if you ever need to bring a claim, you are ready to do so within the limitation period.

Legal Reserve Claims: Statute of Limitations
The right to bring a legal reserve claim is subject to a statute of limitations.
A claim must be filed within one year from the date the entitled heir learns of the commencement of inheritance and of the gift or bequest to be returned, and in any event within ten years from the commencement of inheritance.
