The role of the victim's attorney
- Organizing evidence and drafting the complaintWe organize messages, photos, medical certificates and statements from people around you in chronological order and write the complaint so that investigative agencies can grasp the structure of the case right away.
- Attending interviewsWe go into the victim's interview together, prevent unnecessary questions and secondary harm, and support you so that your account does not waver.
- Inspecting records and opinion lettersOnce trial begins, we inspect and copy evidentiary documents through the prosecutor (Article 294-5 of the Criminal Procedure Act) and submit to the court opinion letters rebutting the defendant's arguments and petitions seeking strict punishment.
- Settlement negotiationWe serve as the point of contact for the other side and include in the agreement not only the settlement amount but also no-approach and penalty clauses and confirmation of deletion of recordings.
Settle, or seek punishment?
Settlement is the victim's right, not an obligation. The offender's side often rushes to settle toward the end of trial to lower the sentence. Stating that you do not wish punishment can greatly reduce the sentence, so you must decide by weighing the settlement amount and the level of punishment together. Among the cases DAEON Law Firm has handled, there were cases where the offender was sentenced to prison and the victim still received a settlement in the range of KRW 20 million to KRW 60 million.
Materials to gather before filing
- The entire conversation with the offender (back up a chat export file in addition to screenshots)
- Messages or call records from telling acquaintances right after the incident
- Hospital treatment and counseling records and medical certificates
- If recordings or synthesized material were posted, screen captures showing the posting address and date
Even for incidents from long ago, the statute of limitations may not have expired. For sex crimes suffered as a minor, the limitation period runs from the day you reached adulthood.
