Divorce & Adultery
Unlike litigation, mediation resolves disputes peacefully in a less formal setting: both parties are given a full opportunity to be heard, all the circumstances are weighed, and a solution is reached through mutual compromise and concession.
Korea follows the mediation-first principle. Divorce mediation is a step that must be completed before a divorce lawsuit can proceed.
This is known as the mediation-first (mandatory pre-litigation mediation) principle. Its purpose is to have the spouses make a genuine effort to resolve their dispute peacefully through mediation before engaging in a courtroom battle.
Divorce by Mediation: Procedure
Because divorce by mediation is not subject to a statutory cooling-off period, if you have already reached a reasonable degree of agreement with your spouse on the terms of the divorce, the process can move faster than a divorce by agreement.

Documents Required for Divorce by Mediation
  • Application for divorce mediation
  • Basic Certificate for each spouse
  • One (1) Marriage Relationship Certificate for each spouse
  • One (1) Resident Registration Certificate (full and abridged) for each spouse
  • One (1) Family Relationship Certificate for each spouse
  • If there are minor children, a Basic Certificate and a Family Relationship Certificate for each child
  • Any other supporting evidence
